North River Shores Variance Approval
The original architects and developers of North River Shores recorded setbacks on the Original Deed of each property in order to maintain the view and aesthetic of each owner. These setbacks are unique to each property. The side setbacks are generally 15 feet, but can vary depending on the property. In order to determine the setback of a particular property you must obtain a copy of the first recording of the deed (Original Deed). Construction Review Process
North River Shores property owners contemplating modifying or physically improving their properties including, new homes, home additions, seawalls, docks, sheds, garages, and fences must seek the approval of the Board of Directors. The application forms may be downloaded, printed and submitted to the Chairman of the Deed Restriction Committee for review and approval. The application forms include detailed instructions to assist the home owner with the process. The Vice President oversees the construction and variance application review process. Construction Application Overview
Applicant will need to prepare a review package containing the following:
- Warranty Deed, or other recorded instrument indicating the current owner(s) of the property.
- Original Deed indicating the recorded setbacks of the property
- Recent Boundary Survey signed and sealed by a Florida licensed professional.
- Site Plan, Plot Plan Survey, scaled drawing(s) showing proposed construction.
- Application review fee (see application form)
All proposed improvement(s) are subject to the properties' original recorded setbacks and applicable covenants and deed restrictions. A new fence associated with a construction application will not require a separate application for the fence.
Construction Approval Process
- Application shall include two (2) original hard copies of all signed and sealed (as required by law) plans and surveys by the appropriate design professionals and two copies of all supporting documents, maps, elevation views, sketches, etc., and one digital copy of the complete application package in PDF format.
- The Board of Directors can only review complete applications. Once reviewed, the Board of Directors will provide written comments, if it is required.
- Upon approval, the Board of Directors will provide the owner an approval letter and a dated and stamped approved set of the construction plans. Owner agrees to notify NRS if any changes are made after approval by the Board of Directors.
- Owner shall notify the NRS when approved construction is completed and ready for inspection within 30 day of construction completion and shall provide the Chairman of the Deed Restriction Committee any "As-built" surveys or Record Drawings required by Martin County Building Department.
The NRS construction application ONLY addresses the requirements of North River Shores. Martin County has its own permitting requirements for construction activities. Please contact the Martin County Building Department.
